This is a vacation rental agreement under the North Carolina Vacation
Rental Act.
The rights
and obligations of the parties to this agreement are defined by law
and include unique provisions permitting the disbursement of rent prior
to tenancy and expedited eviction of tenants. Your signature on this
agreement, or payment of money or taking possession of the property
after receipt of the agreement, is evidence of your acceptance of the
agreement and your intent to use this property for a vacation rental.

SECURITY
DEPOSIT
Guest(s) are required to secure property with a $200.00 security deposit.
Security Deposit must be received with signed Rental Agreement in order
to secure reservations. Security deposits are required by North Carolina
law to be refunded within 45 days but will generally be refunded within
ten days of departure if guest(s) have caused no damage or violated
any policies. All security deposits will be returned to the address
specified by the guest on this agreement.
CANCELLATION
POLICY
All reservations are subject to a 45 day cancellation policy. If booking
is canceled 45 days or more, prior to reservation start date, deposits
will be returned, minus a $50 processing fee. If a booking is canceled
less than 45 days prior to the reservation start date, the deposit is
non-refundable, but may be rescheduled. If booking is canceled 72 hours
or less, prior to arrival date, there are no refunds or reschedules.
Timber Park Properties, LLC cannot refund monies due to circumstances
beyond our control.

TRUST ACCOUNT
Any advance payment made by Tenant shall be deposited in a trust account
with Wachovia Bank (financial institution) located at Charlotte, NC.
Tenant agrees that any advance payment may be deposited in an interest-bearing
trust account and that any interest thereon shall accrue for the benefit
of and shall be paid to, the owner (or as the owner directs) as it accrues
and as often as is permitted by the terms of the account.
PETS
We do have cabins that are Pet-friendly! If you're interested in including
your pet please be sure and fill out the Pet Addendum Form and mail
it in along with your Rental Agreement Form.
LOSSES
AND DAMAGES
Any and all damages to the home or negligence resulting in damage to
the home or contents will result in costs to repair being deducted from
the security deposit or billed to those guests if said damage or loss
of contents is greater than security deposit. Guest(s) shall be solely
responsible for any property damage, accident/injury to any person or
loss sustained by any person, including loss of money, jewelry, and
other items of personal property, arising out of or in any way related
to Guest(s) use of premises or the items of personal property provided
by Timber Park Properties at Guest(s) request. Guest(s) shall inspect
and be familiar with property use and application such prior to using
them. Guest(s) hereby agrees to INDEMNIFY and hold Timber Park Properties,
LLC harmless of any and all claims including those of third parties,
arising out of, or in any way related to Guest(s) use of premises or
the items of personal property therein. Guest(s) assumes the risk of
injury or other losses relating to any recreational activities or services
ordered through the Timber Park Properties for guest use and will hold
OWNER and its Agents harmless with respect there to. Owner and Agent
are not responsible for articles left on premises. There will be a $10
charge in addition to shipping charges for handling the return of any
articles found by housekeeping.
SMOKING
NO SMOKING is permitted inside cabins. Evidence of smoking may result
in partial or complete loss of security deposit.
CHECK-OUT
PROCEDURE
Guest(s) shall leave premises in neat and undamaged condition. All dishes
must be washed and put away. All food must be removed from refrigerator
and cabinets. All trash removed and placed outside of unit for later
pickup. Furniture must be placed in its original location. Doors/windows
locked.
A charge of $10.00 may be charge for grills left unclean.
Linens are provided in your cabin at no additional charge. The rental
will be clean with bed linens folded at foot of bed. You are responsible
to launder and fold all used linens. A fee of up to $15.00 per load
of laundry may be charged for linens left unlaundered or unfolded
You are responsible to remove all garbage from rental. Garbage site
closed on Sunday. Weekend renters may leave 1 sealed bag at no charge.
. In the event the cabin is not cleaned by the tenant we will use a
professional cleaning service to have the unit cleaned at the expense
of the tenant.
Check-in time is after 3:00 P.M. You may go directly to your rental.
Please bring a flashlight if arriving after dark at your rental.
KEYS
Follow instructions listed at the rental cabin.
RETURNED
CHECKS
A $50 service charge will be incurred for any returned check.
NO EXTRA
GUEST/NO HOUSE PARTIES
Rental Guest understands that we will accept families, couples and responsible
adults over the age of 21 ONLY. Guest(s) agree that the premises shall
not be occupied by more than the number of people stated on the reservation.
If the unit is occupied by more than the number of people stated, it
may result in loss of security deposit. Occupancy in use of premises
shall not be such as to disturb or offend neighbors. The use of firearms
or fireworks is strictly prohibited.
TENAT DUTIES:
Tenant agrees to comply with all obligations imposed by the Vacation
Rental Act on Tenant with respect to maintenance of the Premises, including
but not limited to keeping the Premises as clean and safe as the conditions
of the Premises permit and causing no unsafe or unsanitary conditions
in the common areas and remainder of the Premises that Tenant uses.
OWNER DUTIES
Owner agrees to provide the Premises in a fit and habitable condition.
If at the time Tenant is to begin occupancy of the Premises, Owner cannot
provide the Premises in a fit and habitable condition or substitute
a reasonably comparable property in such condition, Owner shall refund
to Tenant all payments made by Tenant.
TRANSFER
OF PREMISES
Upon termination of the owner’s interest in the premises, whether
by sale, assignment, long term lease of 30 days of more, death, appointment
of a receiver or otherwise, the owner is required to transfer all advance
rent and security deposits paid by the tenant to the successor owner.
Should the successor owner not agree to honor this contract, all advance
rent and security deposits will be transferred back to the tenant within
30 days.
If the
owners interest in the property is involuntarily transferred prior to
Tenant’s occupancy of the Premises, the owner is required to refund
to Tenant all advance rent paid by Tenant within 60 days of the transfer.
INDEMNIFICATION
AND HOLD HARMLESS:RIGHT OF ENTRY: ASSIGNMENT
Tenant agrees to indemnify and hold harmless owner from and against
any liability for personal injury or property damage sustained by any
person (including tenants guests) as a result of any cause, unless caused
by negligent or willful act of Owner. Tenant agrees that owner or their
respective representatives may enter the premises during reasonable
hours to inspect the premises, to make such repairs, alterations or
improvements thereto as agent or owner may deem appropriate. Tenant
shall not assign this Agreement or sublet the Premises in whole or part
without written permission of the owner.
VIOLATING
AGREEMENT
If guest(s) violates any of the conditions of this Agreement, Agent
may terminate this Agreement and enter Premises. Upon notice of termination
of this Agreement, Guest shall vacate the Premises immediately. By signing
this, I have read and fully agree to all the above policies.
